Law exists in a society to create rights and impose duties, the observance of which ensures a well-ordered community. However, history has shown that laws are not always observed in ways that guarantee orderliness. This reality makes it necessary to have an institution responsible for ensuring obedience to the law, adjudicating disputes arising from non-observance or breaches of the law, and awarding appropriate redress.
While we cannot fully appreciate or advocate, in theory or practice, the complete independence of the judiciary without understanding the critical role and power of this third arm of government, this paper examines the powers of the judiciary under the 1999 Constitution of the Federal Republic of Nigeria (as altered). It further discusses the independence of the judiciary within our democratic system.
The challenges confronting judicial independence in contemporary times are highlighted, and useful recommendations are proposed to strengthen the judiciary for the advancement of Nigeria’s economy. Learn More
